Terms & Conditions

Welcome to Surrly (the “App”). Please read these Terms carefully. By using the App, you agree to these Terms.


1) Who we are

2) Eligibility & Age

The App is intended for users 16 years and older. We do not permit use by anyone under 16. We do not knowingly collect data from children under 16; if we learn this has occurred, we will delete such data and may disable the account. An age‑gate is shown during onboarding.

3) Your Account & Controls

  • You are responsible for your account and for safeguarding your credentials.
  • Delete account. Delete anytime from Settings. Deletion is permanent and removes your content as described in the Privacy Policy.
  • Export / import. Export your journal as JSON (including base64‑encoded audio) and import supported JSON back into the App.

4) AI Analysis (Model Providers)

To generate interpretations, affirmations, and reflection prompts, we may process your content using third‑party AI model providers (currently OpenAI).

  • What is sent: dream text you input and/or audio you record (or its transcription).
  • Purpose: provide the analysis and related features you choose to use.
  • Backups (Premium only): Premium users may opt in to store server‑side backups of their entries. This is optional and can be turned off in Settings.
  • Provider changes: We may switch to equivalent providers that meet comparable security and privacy standards.
  • We do not authorize providers to use your content for advertising or their own marketing. See the Privacy Policy for details.

5) Notifications

  • Functional reminders. Includes morning reminders to log dreams and routine nudges based on the wake‑up time you set in the App.
  • Marketing pushes. News, updates, or offers are sent only with your separate consent. You can opt out anytime in Settings and system push settings. Access to paid features is not conditioned on marketing consent.

6) Fair Use & Rate Limits

We may apply reasonable rate / daily limits on requests (including AI analyses) and anti‑abuse safeguards to protect the Service and users. Automated access, scraping, or circumvention of limits is prohibited.

7) Subscriptions

We offer monthly and annual subscriptions via Apple in‑app purchase. Prices may vary by region and tax.

  • Auto‑renewal. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your Apple ID settings.
  • Trials. No free trial at this time.
  • Price changes. If Apple requires consent for a price increase, you will be notified and may accept or cancel.

8) Analysis Packs (+10 / +25 / +50)

What they are. One‑time allowances of AI analyses that you can apply to your dream entries.
Quantity at purchase. The exact number of analyses is shown at purchase and may vary across offers or A/B tests.
How usage works. Analyses are deducted per analysis run you initiate.
Not a subscription. Packs do not auto‑renew and are separate from any subscriptions.
Promotional credits. Any bonus/promotional analyses have no monetary value, are non‑transferable, and may be subject to fair‑use and anti‑abuse checks.
Display governs. If this Policy and the in‑app purchase screen differ, the purchase screen controls the quantity and price.

9) Purchases, Billing & Refunds

All purchases are processed by Apple. We do not issue refunds directly. To request a refund, use Apple’s process (e.g., Report a Problem). For EU/EEA users, Apple administers statutory rights of withdrawal; once digital content is delivered (e.g., credits added), the right of withdrawal may not apply.

10) User Content, Feedback & License to Operate the Service

  • Your content. You own your journal entries and media. You grant us a worldwide, non‑exclusive, revocable license to host, process, and display your content solely to operate, secure, and improve the features you choose to use (including AI analysis), consistent with the Privacy Policy. We do not use your entries for our marketing unless you give explicit, separate permission.
  • Feedback. If you send us ideas or suggestions, you grant us a non‑exclusive, royalty‑free license to use them to improve the Service. This does not apply to your journal entries.

11) Acceptable Use (including Prohibited Data)

No unlawful content, harassment, scraping, crawling, bots or automated access; no reverse engineering; no bypassing security, limits or quotas; no malware.
Do not upload payment card numbers, government IDs, passwords or similar sensitive data. Do not include third‑party personal or health data without their consent.

12) Third‑Party Services & Links

The App may integrate or link to third‑party services (e.g., AI model providers). Their terms and privacy policies apply. We are not responsible for their availability, accuracy, or practices.

13) Security & Backups

We employ technical and organizational measures, but no method is 100% secure. Please keep your own backups (export is available in Settings).

14) Disclaimers

The App is provided “as is” and “as available.” We do not guarantee uninterrupted or error‑free operation. Surrly provides wellbeing support only and does not provide medical or psychological advice. If you have concerns about your health, consult a qualified professional.

15) Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for claims arising out of or relating to the App shall not exceed the amounts you paid for the App during the 12 months preceding the claim. Nothing in these Terms limits liability for intent, gross negligence, or injury to life, body, or health.

16) Apple‑Enabled Software; Third‑Party Beneficiary

These Terms are between you and Surrly, not Apple. Apple has no obligation to provide maintenance or support for the App. In case of failure to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); Apple has no other warranty obligations. Your use must comply with Apple Media Services Usage Rules. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.

17) Export Controls & Sanctions

You represent that you are not located in, and will not use the App in, any country subject to EU/US embargoes or on any restricted‑party list. You are not a prohibited end‑user under applicable export or sanctions laws.

18) Service Changes & Discontinuation

We may modify, suspend, or discontinue features or the Service (in whole or part). Where practicable, we will give reasonable notice.

19) Governing Law & Venue

These Terms are governed by the laws of Germany. If you are a business user, exclusive venue is Berlin. If you are a consumer, mandatory consumer protection rules of your usual residence may apply, and venue will follow applicable law.

20) Changes to These Terms

For material changes, we will provide at least 30 days’ notice (e.g., in‑app notice or email) where practicable. Continued use after changes take effect constitutes acceptance of the revised Terms.
